EMPLOYMENT PRACTICES LIABILITY INSURANCE (EPLI)
Employment Practices Liability Insurance
If your business or non-profit organization has employees, you should consider EPLI coverage, regardless of the size of your business. This insurance can protect your business against claims made by past, present, or prospective employees. It may also protect your business from customers, clients, and vendors if you include third party coverage.
Why should companies consider buying EPL coverage?
An employment lawsuit, if not handled properly, can cause irreparable harm to a company’s reputation. The cost to defend against employment lawsuits is high, regardless of the outcome. While some general liability policies have a sublimit included for EPL claims, the sublimits are often low, and there are exclusions in those limited coverage offers.
What are the sources of EPL claims?
Race & Sex Discrimination
Wrongful Termination
Invasion of Privacy
Defamation
Harassment / Discrimination
Emotional Distress
Regulatory Violations & Government Investigations
Employee Misclassifications (Exempt vs. Non-Exempt, W-2 Employee vs. 1099 Independent)
Third-Party: Your customers, clients, or vendors claim you or your employee discriminated against them.

Isn’t this the purpose of my workers’ compensation insurance policy?
Answer
No. Workers’ Compensation insurance policies (purchased through the state if your business is in WA, ND, OH, or WY) protects your employees if they get physically injured while at work. An EPLI policy is designed to protect your business should your employee claim your work environment or employment practices such as hiring and terminating, are discriminatory and/or unsafe.
